These Terms of Service (“Terms”) govern your use of the Ember Dance Center website and services. They are provided by Kasscar Group LLC, doing business as Ember Dance Center (“Ember,” “we,” “us”), located at 9600 66th Street North, Pinellas Park, Florida. By creating an account, booking a class or making a purchase, you agree to these Terms.
You must provide accurate information and keep your password secure. You are responsible for all activity on your account. If you are under 18, a parent or legal guardian must create the account and agree to these Terms on your behalf.
Class passes are sold as credits. Booking a regular class uses 1 credit. While your Unlimited Monthly membership is active, you can book regular classes without using credits. All bookings are subject to availability and to the studio schedule. Intensive Groups, private lessons, events, studio rentals and merchandise are sold separately and may have additional terms shown at the time of purchase.
You may cancel a class booking up to 1 hour before the class starts, and the credit will be returned to your account. Within 1 hour of the start time, or after the class has started, a booking can no longer be cancelled and the credit is not returned.
Unlimited Monthly and each Intensive Group are monthly subscriptions. You authorize us, through our payment processor, to charge your payment method every month until you cancel. You can cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period, and you keep access until then. We do not prorate or refund the unused part of a billing period.
Payments are processed by Stripe. We do not store your full card number. Prices are in US dollars. We may change prices at any time; changes do not affect purchases already made, and we will give notice before a price change applies to your subscription.
Except where required by law or as stated in these Terms, all purchases (credits, passes, memberships, events and merchandise) are final and non-refundable. If you believe you were charged in error, please contact us as soon as possible.
We may change schedules, instructors or rooms, and we may cancel or reschedule a class. If we cancel a class you booked, we will return your credit or offer a reasonable alternative.
Please be respectful toward instructors, staff and other dancers. We may remove anyone whose behavior is unsafe or disruptive, without refund.
Dance involves physical risk. Please consult a doctor if you have any health concerns before participating. The Liability Release Waiver & Studio Policies you accept when registering (including the photo and video release) form part of these Terms.
Donations made through our Foundation page are voluntary and non-refundable. Unless we state otherwise in writing, donations are not tax-deductible.
You agree not to misuse the website, attempt to access other people’s accounts, interfere with its operation, or copy its content for commercial use. The Ember Dance Center name, logo, text, photos and videos belong to us or our licensors.
To the fullest extent permitted by law, our services and website are provided “as is,” and our total liability to you for any claim related to the services will not exceed the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
These Terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Pinellas County, Florida.
We may update these Terms from time to time. The “Last updated” date above shows the latest version. Continuing to use our services after an update means you accept the new Terms.
